Terms of Service for Video Recorder & AI Captions

These Terms of Service ("Terms") govern your use of Video Recorder & AI Captions, a browser extension and related managed AI services provided by ELIT VIRTUAL LLC ("ELIT Virtual," "we," "us," or "our"). By installing, accessing, or using Video Recorder & AI Captions, you agree to these Terms.

1. The Service

Video Recorder & AI Captions helps users record tab audio, create video clips, generate and edit captions, export media, and optionally use AI-assisted caption or metadata tools. Some features work entirely on your device. Managed AI features require an account and available managed credits. BYOK features use the provider and endpoint you select.

We may change, improve, suspend, or discontinue features when reasonably necessary for security, legal compliance, maintenance, or product development.

2. Eligibility and your account

You must be at least 13 years old to use the Service. If you create a Managed AI account, you must provide an email address you control and keep your account secure. You are responsible for activity that occurs through your account and for keeping sign-in codes private.

3. Your recordings and legal responsibilities

You retain ownership of the media, captions, and other content you create with Video Recorder & AI Captions. You are responsible for ensuring that you have all rights, permissions, and lawful grounds needed to record, capture, edit, share, or publish that content.

Do not use Video Recorder & AI Captions to violate privacy, copyright, publicity, recording-consent, platform, or other applicable laws. Do not use it to circumvent DRM, access controls, paywalls, or platform restrictions. Recording features may not work with DRM-protected content.

4. AI features and third-party providers

AI output may be incomplete, inaccurate, unsuitable, or unavailable. Review all captions, titles, social captions, and other AI output before relying on or publishing it. Video Recorder & AI Captions does not guarantee accuracy, language quality, or fitness for a particular purpose.

With BYOK, you choose the AI provider and endpoint. You are responsible for your relationship with that provider, its terms, its charges, and the content you send to it. With Managed AI, we use the provider described in our Privacy Policy to process the text you submit.

5. Credits, purchases, and refunds

Managed AI requests consume credits as shown in the Service. We may offer introductory or promotional credits with their own disclosed conditions. Credits are not cash, are not transferable, and cannot be exchanged for money.

Paid credit packs and subscriptions, if offered, are processed through Stripe. Prices, included credits, renewal terms, and applicable taxes will be shown before payment. You authorize Stripe to charge the payment method you select.

Our Refund and Credit Policy forms part of these Terms. Nothing in these Terms limits a non-waivable consumer right that applies to you.

6. Acceptable use

You may not:

• Reverse engineer, interfere with, or attempt to bypass access, credit, payment, or security controls.
• Use automated means to extract, overload, or abuse the Service.
• Submit unlawful, infringing, harmful, deceptive, or malicious content.
• Use the Service to infringe third-party rights or violate applicable law.
• Resell, sublicense, or commercially exploit Video Recorder & AI Captions except as expressly permitted by us in writing.

7. License and ownership

Subject to these Terms, ELIT Virtual grants you a limited, non-exclusive, non-transferable, revocable license to use Video Recorder & AI Captions for personal or internal business purposes. ELIT Virtual and its licensors retain all rights in the Service, including its software, branding, and documentation, except for your content.

If you provide feedback, you grant us a non-exclusive, worldwide, royalty-free right to use it to improve the Service without compensation or obligation to you.

8. Availability and support

We aim to provide a reliable Service but do not guarantee uninterrupted availability, compatibility with every website, or preservation of local content. You are responsible for exporting and backing up content you want to retain. Contact bilaal@sudarfa.com for support.

9. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIDEO RECORDER & AI CAPTIONS IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELIT VIRTUAL AND ITS SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF USD $100 OR THE AMOUNT YOU PAID TO ELIT VIRTUAL FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

11. Suspension and termination

You may stop using Video Recorder & AI Captions at any time. We may suspend or terminate access to Managed AI or other paid features if we reasonably believe you violated these Terms, created a security or legal risk, or used the Service fraudulently. Sections that by their nature should survive termination will survive.

12. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms with a new "Last updated" date. Continued use after an update becomes effective means you accept the updated Terms, to the extent permitted by law.
